What does Little Elm require for a residential pool?

The Town's Building Safety Division requires a permit for any pool deeper than 24 inches, whether storable or permanent. Electrical and plumbing inspections are required, and the fence must be in place before water goes in the pool.

Residential pool fences must meet the Town's adopted residential code. Windows or doors within five feet of the water's edge must be safety glazed and have alarms. Ask the seller for the permit and final inspection.

Why do lake lots and easements matter for pools?

The Town's rules say no pool or pool equipment may sit in a floodway, a utility easement or any other easement. On lake lots, that includes checking for a U.S. Army Corps of Engineers flowage easement. A survey shows where the pool sits in relation to every easement.

What should a pool inspection cover here?

Expansive clay soils are common in the Dallas–Fort Worth area, and their swelling and shrinking can stress slabs, decks and pool shells. Ask an inspector to check for cracks, leaks, deck separation and equipment age, and review any foundation repair records.

State pool-yard law, Health and Safety Code Chapter 757, covers apartment and property owners' association pools rather than private backyards. Your HOA may add its own fence and equipment rules, so read them before you plan changes.
